    Go see a lawyer..get a prenup..I know this doesn't seem romantic and people are saying if you're thinking these things she's not the right person for you..but, now a days, people have to be realistic, it seems everyone is getting divorced..no I'm not divorced and no I didn't have a prenup..but I would tell my children to get one..

    You should get a pre-nup if you're worried about dividing assets if you divorce...pre-nups are the only way to make sure your ex doesn't get their hands on things you purchased/owned before marriage.

    yes she would get half.. I know I looked all into this and yes you can get a cohabitation contract if before married or prenup if married. After lots of hours with my lawyer he said they can be broken, so if you do not trust this person now, good luck if it doesnt work out. For me their was other legal issues going on with this person so my lawyer and I already knew how dirty he could be. I decided to end the relationship instead of take that chance. I wasn't able to trust the man, and for me, my children will always have a roof over their head.
    You sound like you may have alot of equity in the home just as I did (do) , so really think hard about all the options.. Hope it works out better for u. Goodluck

    The house belongs to both of you after getting married no matter who bought it, unless you had done the house notarization before married.

    This is correct. What's yours/hers prior to marriage is yours/hers upon divorce.......but the appreciation is split 50/50.

    Well,Brad, you better go to a lawyer. Probably you find message boards like this one cheaper....but if you really want everything to be cheaper for you, go to a lawyer...or don't marry at all.

    Simple to answer: Unless you have a pre-nup, she will get half of the house and everything else you own. Also, if you get married and you guys divorce she can also go after half of your pension during the time you were married. Best thing to do is get a pre-nup, or, go to a lawyer and have something done in writing in regards to the house to protect your home. (If the house is the only thing your worried about.)

    The answer depended on how the property ownership was worded on the property deed-it has to do with the words tenants in common or joint tenants with survivorship.
