TRAVELALERTS.CA’S FILL YOUR PLANE 2010
GENERAL RULES AND REGULATIONS

PARTICIPATION
• Anyone who wishes to participate in the contest must be an active member who has subscribed to TravelAlerts.ca’s newsletter by June 18, 2010 at 11:59pm eastern time.
• No purchase required.
• A maximum of 221 entries per Person* for the entire duration of the contest.
• This contest is intended for participation by residents of Canada, ages 18 and over.
• Entrants must be physically located in Canada.
• Individuals employed by TravelAlerts.ca, its affiliate companies, subsidiaries, advertising and promotion agencies, or judges (collectively “Contest Parties”) at any time during the contest period, and members of their immediate family or persons living in the same household, are not eligible.



ENTRIES FOR THE DRAW
• For the purposes of this contest, “receipt” of an internet entry occurs when TravelAlerts.ca’s servers or third party contracted services’ servers record the entry information resulting from the entrant clicking the “Submit” button.
• Each person that subscribes or is already subscribed to TravelAlerts.ca is automatically a participant and gets 1 entry to the contest.

• For every friend that a participant invites (having a unique valid email address) and that accepts an invitation by either registering to our newsletter and contest or, if already subscribed by updating/confirming his/her information, the participant will get 10 additional entries (with a maximum of 70 additional entries) to win the prize. If the participant fills his plane, he will receive an additional 100 entries to the contest.

• For every person that participates in TravelAlerts.ca’s contest after clicking on one of the TravelAlerts.ca contest links or Facebook links provided in this contest, the participant which has published or sent these links will obtain 5 additional entries (with a maximum total of 50 entries).
• For the purposes of this contest, a valid entry is determined by completing the forms through the internet web pages which must be received by June 18, 2009 at 11:59pm. Automated entries (including but not limited to entries submitted using any robot, script, macro, or other automated service) are not permitted.
• Multiple entries will disqualify all entries submitted. All entries become the property of TravelAlerts.ca and will not be returned. All winners must meet the eligibility requirements set forth in these rules in order to qualify for the prize. TravelAlerts.ca is not responsible for any failure of the website during the contest period, including any telephone problems or technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the internet or at the website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from downloading any material related to the contest, all of which may affect a person’s ability to participate in the contest. Entries with invalid email addresses will be disqualified.
• By participating in this contest, entrants agree to release and hold harmless contest Parties and each of their respective parent companies, affiliates, subsidiaries, officers, directors, representatives, agents and employees, from any and all liability whatsoever for any injuries, losses or damages of any kind arising from or in connection with, either directly or indirectly, 1) the awarding, acceptance, receipt, possession, use and/or misuse of any prize awarded herein; or 2) participation in the contest or any prize related activities, including but not limited to traveling to or from any prize related activity. TravelAlerts.ca is not responsible for technical delay issues that may cause an expired contest to be printed on any advertising notification of the contest.

PRIZES
• There will be one prize awarded (for up to 8 people). The qualified winner will receive $2,500 for his trip and $2,500 per additional passenger that has accepted his invitation and who he still wishes to invite on his trip. TravelAlerts.ca is not responsible for the winner(s) choice of travel companions.
• Airline ticket(s) must depart from the same Canadian airport of origin going to the same destination on the same flight.
• The winner will make his own travel arrangements and TravelAlerts.ca will give the winner and his friend(s) $2,500 per person (or $20,000 maximum total) including all taxes and surcharges.
• Travel must be completed before June 18th 2011.
• TravelAlerts.ca expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of prizes awarded. TravelAlerts.ca makes no representation or warranties concerning the appearance, safety or performance of any prizes awarded.
• TravelAlerts.ca reserves the right to award the prize to the winner(s) in cash. In this case, the maximum payment will be the value of the prize, which is $2,500 for the winner + $2,500 for each person that has accepted his invitation(s).

THE DRAW
• Odds of winning: The actual odds of winning will depend upon the actual number of entries received for this contest.
• Random drawing: There will be 1 winner. The winner will be chosen by random draw from all eligible entries. The draw will take place on June 25, 2010 at 5:00pm (subsequent draws may be needed if entrant does not claim his prize by the deadline specified), at 410 St-Nicolas, Suite 508, Montreal, Qc, H2Y 2P5.

CLAIMING PRIZE
• The selected entrant will be contacted by email between June 25, 2010 and July 9, 2010 to confirm his choice and acceptance of the prize.
• In case the prize has not been claimed by the selected entrant before July 23rd, 2010 at 5:00pm, TravelAlerts.ca will forfeit his right to the prize.
• Before being declared a winner, the selected entrant will be required to 1) correctly answer the following skill testing question: (9 x 8) + (99/9) - 5 = ; and 2) complete, sign and return a release form confirming:
o compliance with the contest rules;
o acceptance of the prize as offered;
o acknowledgement of the right of TravelAlerts.ca and their respective agents to publish the winner’s picture, name and address, without compensation other than the prize offered;
• The prize will be delivered to the winner(s) address(es).
• Should a winner make any false statement(s) in any document referenced above, the winner will be required to promptly return to TravelAlerts.ca his/her prize. Any unclaimed prizes will be awarded in a random drawing to be held as necessary. In the event there is a dispute of the entrant’s identity, the prize will be awarded to the established email account associated with the entry.
• By participating, entrants agree to abide by and be bound by these General Rules and Regulations the decisions of the judges, which shall be final and binding with respect to all issues relating to this contest. It is your responsibility to ensure that you have complied with all of the conditions contained in the General Rules and Regulations. By participating in this contest, entrants agree to TravelAlerts.ca's use of their personal information for direct marketing purposes.

APPLICABLE LAW
• Quebec Residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
• The contest is subject to federal, provincial and local rules and regulations.

MISCELLANEOUS CONDITIONS
• If, for any reason, the contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of TravelAlerts.ca, TravelAlerts.ca reserves the right, at its sole discretion, and as permitted by law to cancel, terminate, modify or suspend the contest and select winners from among all eligible entries prior to the cancellation. Persons found tampering with or abusing any aspect of this contest, or whom TravelAlerts.ca believes to be causing malfunction, error, disruption or damage will be disqualified. TravelAlerts.ca reserves the right to correct any typographical, printing, computer programming or operator errors.

* For purposes of this contest, a Person is defined as a valid and unique email address.
