OTTAWA — The government is moving “very quickly” to draft new legislation to prevent heinous offenders — like infamous killer Karla Homolka — from easily being pardoned for their crimes.
While Public Safety Minister Vic Toews said legislation could be tabled this fall or sooner, Homolka is eligible to apply for a pardon in July having lived crime-free for five years following her 2005 release from prison.
She served only 12 years for three manslaughter convictions, having made a deal to provide evidence against her then-husband Paul Bernardo.
Prime Minister Stephen Harper Monday blamed “soft-on-crime attitudes” of the past, when “concern for criminals took priority over compassion for victims.
“The law will allow Karla Homolka to apply for a pardon this year,” Harper said. “In fact, more than 99% of pardon applications that reach the adjudication stage are granted.”
The National Parole Board has said recently the Criminal Records Act doesn’t allow the board members to distinguish between types of crimes, only to ensure a convict is eligible.
Given them discretion to take into account the nature of the crime or history of the criminal is one change Toews is eyeing. Currently only criminals serving life sentences or dangerous offenders are not eligible for pardons.
Speaking Monday to a crowd of about 100 that included victims of crime and victim advocates to start the fifth annual National Victims of Crime Awareness Week, Harper said it was also “offensive” that child serial killer Clifford Olson received a taxpayer-funded pension in prison and former hockey coach Graham James was pardoned for sexually assaulting some of his players in the ’80s and ’90s.
Public Safety Minister Vic Toews said Monday his staff is working “very quickly” to craft options to reform the pardon system, which came under fire two weeks ago when it became known that James had been pardoned in 2007.
While Harper urged Parliament Monday to “get tough on criminals” and to “pass our vital law-and-order legislation,” his critics charged it’s Harper, not the opposition parties, who are playing political games with the justice system.
“They have the audacity to criticize us for delaying the bills they killed through prorogation,” said Liberal Public Safety Critic Mark Holland.
Seventeen justice bills died when Harper prorogued Parliament late last year.
“It’s hypocrisy in the extreme, and the government continues to play games with crime,” Holland said.
This year’s theme for the Victims of Crime Awareness Week is “Every Victim Matters.”
Homolka and her husband were found guilty in the death of Tammy Homolka — Karla’s younger sister — Leslie Mahaffy and Kristen French in the 1990s.
