OFFICIAL CONTEST RULES
THIS CONTEST IS INTENDED ONLY FOR RESIDENTS OF CANADA IN SPECIFIED REGIONS AND WILL BE INTERPRETED ACCORDING TO CANADIAN LAW
1. Contest Sponsor is Kashi Company. No purchase is necessary. This Contest is open to all legal residents of the following four (4) participating regions in Canada: 1. Ontario, 2. Quebec, 3. New Brunswick, Nova Scotia, Prince Edward Island, Newfoundland and Labrador, and 4. British Columbia, Alberta, Manitoba, Saskatchewan, all who have reached the age of majority in their respective jurisdictions and who have existing internet access and a valid email account/address. Official contest entry forms and contest rules are available at www.kashiwin.ca. Registration is required to enter the contest. Online entries must be received between October 2, 2008 12:01 a.m. (EST), and November 21, 2008 11:59 p.m. (EST). LIMIT: One (1) entry per day per person or e-mail address. More than one (1) entry from a single person or e-mail address on any single day will void all entries from that person or e-mail address. In the event of a dispute as to the identity of a winner based on an email address, the winning entry will be deemed to be made by the authorized account holder of the email address at time of entry.
2. There will be a total of four (4) prizes available to be won; one (1) will be awarded per participating region. Each prize consists of a choice of one (1) of five (5) Canadian Spa Getaway trips for two (2) people to: Post Hotels and Spa Lake Louise, Alberta, The Magnolia Resort and Spa, Victoria, British Columbia, Ste.Anne's Inn & Spa, Grafton, Ontario, Fairmont Manoir Richelieu, La Malbaie, Quebec or Fairmont Algonquin, St.Andrews by the Sea, New Brunswick.. Each prize also includes return airfare for two (2) from a major international airport nearest the winner's home within Canada (airport, carrier and airline ticket class selected at the sole discretion of Kashi Company) to the selected trip prize destination (Calgary, Victoria, Toronto, Quebec City, or Saint John), seven (7) nights double occupancy accommodation (accommodation to be selected at the sole discretion of Kashi Company), and $1,000 CDN spending money. For the Post Hotels and Spa Lake Louise, Alberta, Ste.Anne's Inn & Spa, Grafton, Ontario, Fairmont Manoir Richelieu, La Malbaie, Quebec and Fairmont Algonquin, St.Andrews by the Sea, New Brunswick, trip prize options, car rentals will be provided. For the Post Hotels and Spa Lake Louise, Alberta trip prize option, a $200 spa credit will be provided. All other expenses not specifically mentioned herein, including ground transportation, meals, beverages, gratuities, travel documents, tax, personal expenses and all other expenses not specified herein are the sole responsibility of the winner. Transportation and accommodations subject to availability, blackout periods, government restrictions and regulations, hotel, airline, airport or other transportation restrictions and regulations. Other restrictions may apply. Winners must have all necessary identification and/or travel documents required for travel.
3. The approximate retail value of each prize is $9,000 CDN, depending on winner's point of departure and airfare fluctuations. Prize is not redeemable for cash, lottery, prescription, or alcohol items.
4. At approximately 2:00 PM EST on December 12, 2008, a random draw from all entries received by the dates and times indicated above will be conducted by the Contest Judge, Marco Sales, at its offices in Brantford, Ontario to determine potential winners. One (1) potential winner will be selected from each of the four (4) participating regions. All of the eligible entries received will be subject to a computerized, random draw to select the potential winners. Immediately after the draw, Marco Sales will contact the potential winner(s) by return e-mail at the account/address used to enter the contest which must still be valid. Potential winner(s) will have 7 days after being contacted by email to contact the Contest Judge by e-mail (or telephone) using the email address [or telephone number] provided in the email notification. In order to be declared a winner, he or she must comply with all the requirements of these rules; noncompliance with the rules is grounds for disqualification. Prior to the potential winner being declared a winner, he or she will be required to correctly answer a mathematical skill-testing question without the aid of any mechanical, electronic or similar device. Upon answering the question correctly, the Contest Judge will make arrangements for awarding the prize. Should the potential winner not reply to the Contest Judge by e-mail [or telephone] within the specified timeframe, or the potential winner does not otherwise comply with the contest requirements, that potential winner will be deemed to have forfeited any rights to his or her prize and the Contest Judge and Contest Sponsorwill have the right to select an alternate potential winner from among the remaining eligible entries and contact such persons in the manner provided above except that the alternative potential winner will be given a new deadline, which shall be 7 days after contact is made. Before being declared a winner, a selected entry must be verified by the Contest Judge and Contest Sponsor. Winner agrees to accept his/her prize as awarded, and the prize is not transferable or convertible to cash or credit. Contest Sponsor retains the right, in its absolute discretion, to make substitutions of equivalent kind or value in the event of the unavailability of any component of the prize for any reason. These decisions on all issues relating to the contest will be final and binding on all entrants.
5. Odds of winning depend on the total number of eligible entries received (from each region). Entries that are submitted from unauthorized sources as determined by the Contest Sponsor will be disqualified. The Contest Sponsor or Loblaws (and their respective affiliates) assume no responsibility for late, lost, stolen, delayed, illegible, incomplete, or misdirected entry forms, or human error, or technical malfunctions, including but not limited to inability to access the website, lost, delayed or incorrect data transmission, interruption or failure, other electronic malfunctions, computer or telephone hardware or software failures, malfunctions or garbled transmissions. The Contest Sponsor or Loblaws (and their respective affiliates) are not responsible for any problems or technical malfunction of any telephone lines, computer online systems, servers, or providers, computer equipment, software, or injury or damage to entrant's or any other person's computer related to or resulting from participation in the contest or downloading any materials in relation to the contest. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the contest will result in disqualification. Any such action may be in violation of civil and criminal laws and the Contest Sponsor and Loblaws reserves the right to seek damages from any such person to the fullest extent permitted by law. None of Loblaws, Contest Sponsornor their affiliates, or franchisees or advertising and promotional agencies or agents, officers, directors, employees and representatives shall be responsible in any way for the use of or bear any liability whatsoever in any way attributable to an entrant's participation in this contest or the prizes awarded in this contest, including liability for any injury, loss or damages of any kind to persons, including death, and property. Prior to delivery of the prize, the potential winner will be required to sign and return a form satisfactory to the Contest Sponsorconfirming compliance with the contest rules and acceptance of the prize; permitting Loblaws and the Contest Sponsor and their affiliates and respective franchisees to use the winner's name, address, photograph and/or video image in any publicity and advertising without compensation, where legal; and releasing Loblaws, the Contest Sponsorand affiliates and their respective franchisees and advertising and promotional agencies, and their respective agents, officers, directors, employees and representatives from any and all liability, damages, costs, expenses and claims arising out of or relating to the entrant's participation in this contest or the prize. In the event that the potential winner fails to sign such form, he or she will be deemed to have forfeited the prize, and an alternative potential winner will be selected by Contest Judge and /or the Contest Sponsorfrom among the remaining eligible entries.
6. Employees, officers, directors, representatives and agents of Loblaws and the Contest Sponsorand affiliated companies and franchisees and their respective promotional agents, and Contest Judge, as well as those with whom such persons are domiciled, are not eligible. By entering, each entrant agrees to abide by the contest rules and to the decisions of the Contest Sponsorwhich are final and binding in all respects. All entries become the property of the Contest Sponsor and none will be returned. Loblaws and the Contest Sponsor and their affiliates and respective franchisees shall have the right at their option to publish the winner's name or to use the winner's name, address, photograph and/or video image for marketing and/or promotional purposes, without compensation, unless otherwise prohibited by law. No correspondence or communication will be entered into except with a selected entrant. Contest is subject to all applicable federal, provincial and municipal laws, and all applicable local, state, provincial, federal or international taxes, duties or fees are the sole responsibility of each winner and will be paid by the winner.
7. The Contest Sponsorreserves the right in its absolute discretion to modify or withdraw this contest at any time, in whole or in part, without prior notification, for any reason, subject to the approval of the Régie des alcools, des courses et des jeux in Quebec.
