Agreements between competitors to fix prices, to allocate customers or geographic markets, or to restrict production of a product by setting quotas among competitors or other means are considered to be "hard-core" cartel activities, with no socially redeeming features.

    Globe and mail.
Over the past several months, major suppliers of items ranging from Coke to Delissio pizza, Folgers coffee and Chef Boyardee spaghetti have told grocers they will pull funding for flyers and other promotions for the products – and in some cases potentially suspend or limit product shipments – unless the retailer agrees to the new pricing policy, according to documents obtained by The Globe and Mail.

The globe and mail received actual documentation to back up the article. Basically the above means all of these major companies can limit or stop advertising revenue legally but it also stops their product from being advertised in the store, In the case of not allowing orders to go through, deciding to ship to compliant stores and canceling orders or even production due to non compliance with their min price advertised is not a legal move. The difference is this is not a agreement between the competitors... it is the competition behind the scenes at the manufactures setting prices. If you don't think that is illegal ask Hershey... they settled a class action +20 million dollar lawsuit in the fall for such activities.

That's really interesting info Cheeky. I've been wondering where all the big loss leader adds had gone to, I really noticed when I was able to Canada wide PM @ Walmart, that the front pages of the flyers didn't have the best deals for the store. I spent 17years with Safeway and it used to be that your loss leaders were on the front page of your flyer to draw people into your store. I wouldn't think the large chains would be happy with these demands, it will be interesting to see what they will do.

^^ That is just it... over the last year all of the sale prices are now virtually identical. It didn't used to be a 3 cent difference in prices. One would have it cheaper one week... the next week someone else would have something else. This has changed one supplier at a time so slowly that people are not noticing the differences. The walmart price match is fantastic... and it redirects our attention away from the real problem at hand.

Your Govt of Canada quote is totally unrelated to what's happening with the Globe and Mail story. Competitors aren't getting together and fixing prices (like the chocolate bar incident last year).. the grocers don't actually support this. Many companies already do it.. that's why you see items with gift card bonus, etc.

Coke, Nestle, etc. could be shooting themselves in the foot with this practice.. if Safeway, Loblaws, etc had the balls they'd respond to these 'threats' from the supplies with a delisting of product from their stores (even temporary). Can you imaging Sobeys calling up Coke and asking them to remove all products from their stores?

I just upgraded to the World Airmiles MC... It took some "negotiating" but I managed to get the first years fee waived. Now, my question to all you smart folks... Do you know how to book a flight to get the 25% off? Do you have to call in?

Of course that isn't going to happen--saw the SDM flier headlining the "SALE" prices on Soft Drinks--Coke/Pepsi selling EXACTLY at $3.30 for 12--gee what a surprise!!

Seriously, most stores are trying so hard to improve/maintain revenues, they would NEVER pass up those promotional dollars provided by the manufacturers. I'm sure this applies to the great Wal Mart empire, but perhaps their massive size allows them SOME discretion. As to the rest, I'm sure the fix is in, and those prices aren't coming down across the country anytime this century.
