    Cosby to trial on sexual assault charge

    NORRISTOWN, Pa. (Reuters) - A Pennsylvania judge on Tuesday ordered comedian Bill Cosby to stand trial on accusations of sexual assault, the most serious setback so far for a man who epitomized the all-American dad on the 1980s sitcom "The Cosby Show."


    Judge Elizabeth McHugh found that prosecutors presented enough evidence to support allegations that he drugged and assaulted a woman in 2004. The judge rejected arguments from Cosby's defense lawyers that the case should be thrown out.
    As the hearing concluded, McHugh wished Cosby luck, to which the 78-year-old entertainer responded, "Thank you."


    The decision followed a 3-1/2 hour preliminary hearing in Montgomery County, Pennsylvania, where prosecutors introduced statements that Cosby and the woman, Andrea Constand, separately gave to police in 2005.
    Constand herself was not called to testify, although prosecutors said she is prepared to appear as a trial witness.

    Constand, a former basketball coach at Cosby's Temple University alma mater, is the only woman whose accusations of sexual assault have resulted in criminal charges against Cosby.


    But Cosby has been hit by sexual assault allegations from more than 50 women. He has denied assaulting anyone. Most of the cases are too old to be prosecuted, but the entertainer faces civil lawsuits from his accusers.


    A trial date in the Pennsylvania criminal case has not yet been set. Cosby faces up to 10 years in prison if convicted of the most serious charge against him, aggravated indecent assault.

    He Won’t Testify At His Sexual Assault Trial


    With Bill Cosby’s sexual assault trial scheduled to begin on June 5, the embattled comedian has broken his silence by giving his first interview in two years, revealing he won’t be testifying at the trial.

    In an interview with Michael Smerconish on his Sirius XM radio show, Cosby suggested that the more than 50 women who have accused him of sexual assault are “piling on” and implied that racism is underlying the accusations.

    During the interview, Cosby was asked whether he’d be testifying in the trial, and he said he wouldn’t, discussing how lawyers are able to twist the words of a witness.
    “When you have to deal with examination, cross-examination, et cetera, et cetera, more than two sides to every story – sometimes it’s four or five,” said Cosby.

    omg... racism? That word is beginning to lose all meaning, it's being thrown around so friggin' much these days. It doesn't matter whether he testifies or not, he's going to be skewered to the wall either way, deservedly so. .

    The jury deciding Bill Cosby’s fate at his sexual assault trial adjourned on Tuesday after 16 hours of deliberations over 1-1/2 days failed to produce a verdict.

    Earlier in the day, the jury had asked to rehear the testimony of a police officer who was present in 2005 when Andrea Constand first reported the 2004 incident and reviewed portions of sworn depositions that Cosby gave more than a decade ago.

    In addition to revisiting testimony, the jury also asked Judge Steven O’Neill to clarify how to determine whether Cosby gave Constand an intoxicant “without her knowledge,” an element of one of the charges he faces.
    O’Neill said he could not provide any interpretation beyond his initial instructions on the charges.

    Cosby Trial Jury Deadlocked

    Thursday marked the ninth day of Bill Cosby‘s sexual assault trial, and the fourth day of jury deliberations. The jury reported to judge Steven T. O’Neill that they are deadlocked and unable to reach a unanimous decision.
    “We cannot come to a unanimous consensus on any of these counts,” the jury said in a note sent out at 11:06 a.m. ET, after more than 30 hours of deliberations.


    O’Neill ordered the jury to continue trying to reach a verdict despite their inability to reach a consensus, as is their sworn duty. He also denied a motion for a mistrial filed by Cosby’s lawyer.
    “Do not feel compelled to surrender your honest belief,” he said, adding a caveat.

    Juror says accuser should have dressed properly

    The male juror who said Andrea Constand should have been "dressed properly" when she visited Bill Cosby's house got a dressing down by two of the comedian's other accusers Friday.
    Accusers Linda Kirkpatrick and Lili Bernard attended Cosby's sexual assault trial in suburban Philadelphia this month and said they were deeply distressed by the juror's comments to the Philadelphia Enquirer.
    "People ask, 'Why don't victims come forward sooner?' Well, it's because of comments like this. Because we know we'll be blamed," Kirkpatrick, 60, told the Daily News.
    "This is the type of archaic thinking that says a wife can't be raped, a prostitute can't be raped, a stripper can't be raped,” she added. “They can be."
    Bernard, 53, echoed those sentiments.
    "I wasn't surprised by the hung jury, but I was flabbergasted by the ignorance spewing out of this man's mouth. It's just senseless," Bernard said.
    "It's a reminder of how we need to educate society. We need to debunk these rape myths.”
    In his interview with The Enquirer, the unidentified juror suggested Constand proved her interest in a romantic relationship with Cosby by wearing clothing that exposed some of her midriff during a visit to the actor's suburban Philadelphia mansion.
    He also found fault with the incense and bath salts Constand brought to Cosby, proving he wasn't swayed by her testimony the bath salts were actually from a different friend and only delivered by Constand with the belief they were for Cosby's wife.
    "Let's face it: She went up to his house with a bare midriff and incense and bath salts. What the heck?" the man told the newspaper.
    He said Constand should have gone to Cosby's home only if she was "dressed properly and left the incense in the store."
    The man said he found Cosby's words to police and during depositions more believable than Constand's account of what happened the night of her alleged assault in January 2004.
    "He was extremely honest. He admitted to things," the juror said of Cosby.
    The juror also viewed Constand's mother as the driving force behind her decision to report the incident to police a year after it occurred.
    "It was her mother who forced all this," he told The Enquirer.
    "'She should have reported it sooner,' and, 'Look what she was wearing,' says the man who's never been sexually assaulted before," Kirkpatrick said Friday. "This is rape culture, to blame the victim."

    Bill Cosby retrial on sexual assault charges slated for November

    According to The Associated Press, a judge revealed on Thursday that the actor will return to trial on November 6, almost 5 months after his sexual assault trial was declared a mistrial.

    (Andrea) Constand’s lawyer, Dolores Troiani, said that she will be ready come November to see the case close no matter the result. “She wants to see justice done and she wants to see this through. She was in the courtroom after the deadlock comforting everyone else,” Troiani said.

    Guilty on all three counts of indecent assault trial

    Bill Cosby has been convicted of all three counts of against him in his indecent assault trial.The jury reached its decision Thursday. The panel began deliberating Wednesday around 11 a.m.
    Cosby was convicted on three counts of aggravated indecent assault for drugging and sexually assaulting Andrea Constand in a Philadelphia suburb in 2004. The 80-year-old former comedian faces up to 10 years in prison on each count, but would likely serve them concurrently.
    The jury deliberated for more than 14 hours over two days to reach the verdict.

    Did you all hear his rant in court?
    When his being a flight-risk was being discussed, the prosecution said that he owned a private plane, and cosby yelled at the top of his lungs, "He doesn't HAVE a private plane, you a$$-****!!" Niiiiice breakthrough from that "gosh I'm just a nice guy" facade!

    Did ya hear how Cosby yelled at the Prosecutor after they suggested to the Court that he may be a flight risk? Why is that asked the Judge? Because he owns several homes and has a private airplane.
    Cosby stood up and yelled " I DON'T have a plane a**hole! "
    Wow....pick yer battles Bill......you take such offense to people thinking you own a plane?
