Hi all,
I've had problems with my new landlord since they bought my building from my previous landlord. I decided to submit a letter to them with all the maintenance issues, her response was *you know your going to have to move because we are moving in now*
Really, your going to threaten a family that has lived in this apartment for 8 yrs, when we have a valid reason to complain?
Here is my list of complaints, we've had to live with them for 3 yrs, kept getting told they will do them eventually. Do you think I have a leg to stand on? Here is the letter I gave her.
This is a letter to advise you about maintenance issues that you requested as per our conversation on Sept.12th 2010.
1.=Washroom Facilities-Hot water is very low (requiring us to almost completely shut off cold water during showers to even have a somewhat decent temperature) and the water temperature in our apartment is not hot enough to do daily cleaning when other apartments or the spa is using the water source. I get limited access to hot water during spa hours and when other tenants use water. A stabilizer needs to be installed and hot water temperature needs to be adjusted. We advised you about this issue before opening the spa but nothing was done and now the hot water has been turned down to accomodate the spa clients and not the tenants.
Also since skylights were removed we do not have ample light in our bathroom (since the only light source is behind a wall), a new light fixture needs to be installed in the ceiling.
Our bathroom fan also needs to be fixed since it does not work properly (does not turn on sometimes or squeals when turned on and doesn't seem to remove any moisture at all)
Caulking was not applied properly to shower surround and piece near floor still missing.
Toilet is loose (may be leaking)
Bathroom skylight holes covered with spare tiles from the spa looks as if there may be a leak still since the tile has a watermark on it.
I'm also getting a lot of silverfish/waterflies in the bathroom from a possible leak.
Certain minor work has yet to be completed properly that was started in Sept. 2008.
2.=Kitchen-Cabinets do not open and close properly, drawers have been broken since we moved in, causing wood to chip off and fall into cupboards below.
Door knob on main door keeps sticking and will not allow me to open with my key.
Caulking around sink is causing food and debris to get stuck in it (caulking is soft and sticky), making it unsanitary.
Replacement fridge is not level (was also dropped off full of mouse feces and dirt which I had to clean).
3.=Child's Bedroom-Since taking out the skylights my son has no natural light in his bedroom and no air circulation. Subject to subsection (2) & (3) every bedroom, living room and dining room shall have a window to the outside of the building as per O. Reg. 517/06,s.22. (Ontario Regulations for Tenancy 2006/Section 3.03 Property Standards By-Law #66-2008) There used to be a skylight and now was removed which is against Ontario regulations.
Skylight hole stuffed with junk (wood, debris) and not filled in properly.
4.=Livingroom-Light socket is pushed into wall, not properly anchored, loose.
Air conditioner was not installed properly by previous landlord causing gaps and openings around it letting in cold drafts during winter and wasps in summer. Needs to be installed properly and insulated around, permenant removal of A/C is not an option due to the unbearable heat during summer months (escalating to over 100 degrees) and lack of air circulation throughout the apartment since the apartment only has one opening 12inchx10inch window that is located in a back bedroom(apartment was rented to us with A/C services included).

5.=Hallways & Parking Area-Hallways have been cleaned twice by the landlord since taking over(once a year).We have also had people doing crack/drugs in the hallway (I took photo's of their drug stuff left in the hallway), the doorbell installed doesn't work since it's located in the hallway and all apartments have to share it. We know this because we were locked out on 2 different occasions with no one able to hear us. This is an official request to have these issues fixed.
Vacuuming needs to be done at least once a month, perhaps more during winter months, I have done this on occasion because it was unbearable (pulling a whole grocery bag of garbage from hallway).
Back parking area is pitch black at night, needs ample lighting.
No emergency lights in hallway during power failure.
Railings are loose in hallway.

Bring a copy of this to the "landlord and tennants" act and if needed (due to crack and cocaine use (with pic) ) to the police as well! Good Luck!
PS, you might want to see a lawyer afterwards...

Yikes! Getting evicted wouldn't be good but it sounds like getting out of there and moving somewhere else will be a really good thing!

make sure you give a copy of the note you gave to the landlord as well as a copy (they have to give you a written copy just telling you is not legal) of the landlords response. take pictures of all the issues like lack of windows... to include in your report include as much information as possible about requests to fix issues. A lawyer may be a good idea if things get to that point

These are just some of the 42 pics I took and I'm not done yet.
The fact is I dont want to move, this is a perfect area, close to everything! I shouldn't have to move or feel threatened because I want my apartment to be normal.

I dont think they can kick you out for complaining. Seems like their runninga slum not an apt building.
I wouldn't of put up with the drug use once.
